1. General

The general terms and conditions apply to the sale and delivery of goods through the website operated by the provider (www.books-on-stage.com). Deviating conditions of the buyer are only valid if the provider has agreed to them in writing. By placing an order, the buyer agrees to these general terms and conditions and is bound by them.

2. Prices

The product prices stated on the website www.books-on-stage.com include the statutory value added tax of 20%. For sales to companies within the EU there is no Austrian sales tax if the UID number is provided. If a VAT-free invoice is to be issued, the buyer sends a request to shop@books-on-stage.com.

3. Shipping and payment

3a. Shipping tariffs:

Shipping in Austria: € 5,40
Shipping to Germany: € 13,20
Shipping to the rest of the EU*: € 15,00

Belgium, Bulgaria, Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, Czech Republic, Hungary, Cyprus
Please note that shipping to the EU overseas areas or to all areas not belonging to the customs and tax area of the EU (such as Greenland, Canary Islands, Ceuta, Melilla, Channel Islands etc.) is not permitted.

3b. Worldwide shipping

For everyone under 3a. Countries not listed are subject to weight-dependent shipping costs. The prices will be announced on request.

3c. Special information on shipping abroad

Deliveries abroad may incur duties, taxes and charges that are not included in the total price shown.

3d. Payment methods

Payment is only possible against prepayment. After ordering, you will receive an invoice at the email address provided. Payment is made by bank transfer to the provider’s account. The invoice number must be stated when making the transfer.

4. Delivery times

If the ordered goods are in stock, they are dispatched within 3 working days after receipt of payment. For the post, please also expect the following delay: Austria: 1-3 working days, Germany: 2-4 working days, rest of Europe: 3-8 working days. If the goods are not in stock, the expected delivery date will be announced on the website and on the invoice. If the specified delivery date is delayed, the provider will inform the buyer. If the customer does not agree with the delay in delivery, he can withdraw from the contract. In this case, the invoice amounts already transferred will be remitted.

5. refund policy

The provider guarantees a right of return for unused, undamaged goods within 14 days. The return period is met by sending the goods on time (invoice date). The goods must be returned in perfect condition in the original packaging and franked to the provider. The return is at the risk of the buyer. The product costs (but not the shipping costs) for returned goods will be transferred back to the buyer by the provider. In the event of obvious signs of wear or damage to the product, the reduction in value or the value must be replaced by the buyer; a corresponding amount will be retained.

6. Warranty

The provider guarantees that the goods sold are free from material and manufacturing defects at the time of dispatch. If goods arrive at the buyer incorrectly despite perfect packaging, the buyer must inform the seller. If a defect occurs, the provider will replace the product free of charge or return the amount paid. To assert the warranty claim, you only need the original invoice or the payment receipt.

7. Retention of title

The delivered goods remain the property of the provider until full payment has been made.

8. Right of withdrawal

8a. Right of Withdrawal

Consumers have a statutory right of withdrawal. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

8b. Withdrawal period

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. To exercise your right of withdrawal, you must tell us:

inform you of your decision to cancel this contract by means of a clear declaration (e.g. a letter sent by post, fax or email). To meet the cancellation deadline, it is sufficient for you to send your communication regarding your right of cancellation before the cancellation period expires.

8c. Special notice / exclusion of the right of withdrawal

The right of withdrawal does not exist for distance contracts

  • for the delivery of goods that are made to customer specifications or
  • are clearly tailored to personal needs or
  • which are not suitable for return due to their nature or
  • can spoil quickly or
  • whose expiry date would be exceeded
  • for the delivery of audio or video recordings or software, provided that the data carriers supplied have been unsealed by the consumer or
  • for the delivery of newspapers, magazines and magazines, unless the consumer has made his contract declaration by telephone.
8d. Consequences of withdrawal

If you cancel this contract, we have made all payments we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you chose a different type of delivery than the cheapest standard delivery we offer have) to repay immediately and at the latest within fourteen days from the day on which we have received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send off the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the nature, properties and functionality of the goods.

10. Place of jurisdiction

The place of performance for all contract points is Linz. Austrian law is applicable to this contract. The contract language is German. This also applies if the order is placed on the English website of the provider.
